Who Can Benefit From DACA?

DACA is not intended to be a permanent solution for young nonimmigrant aliens. It is not a path to a green card or citizenship. However, qualified young people can reapply every two years, indefinitely. Through DACA, the United States has placed a priority on pursuing other types of deportation cases while deferring action in cases involving qualified young people who:

  • Were younger than 31 years old on June 15, 2012 and were physically present in the U.S. on that date
  • Were brought to the United States before age 16
  • Have lived in the U.S. continuously since June 15, 2007
  • Are in school or have received a GED or are honorably discharged veterans of the U.S. Armed Forces
  • Have not been convicted of serious crimes or significant misdemeanors
  • Do not pose a threat to the security of the U.S.
