35,000 additional h-2b visas available for temporary workers | godoy law office immigration lawyers

35,000 Additional H-2B Visas Available for Temporary Workers

Due to high demand from American businesses, an additional 35,000 H-2B visas – double the norm – for temporary nonagricultural worker visas are available for FY 2022. The United States is experiencing a shortage of workers, and for the summer months, many seasonal businesses such as hotels, resorts, restaurants and other tourist and seasonal businesses need foreign workers. Of the additional 35,000 H-2B visas,

  • 23,500 will be allocated to returning workers who received H-2B status within the past 3 years
  • 1,500 will be allocated to nationals from El Salvador, Guatemala, Haiti, and Honduras

The additional H-2B temporary nonagricultural worker visas are available for the second half of FY 2022, and is more than double the usual 33,000 allocated for the summer.

What Is An H-2B Visa?

The H-2B program provides temporary work authorization to noncitizens that are hired for temporary labor or services in the United States, and allows employers to bring foreign national workers to the United States for temporary, seasonal, nonagricultural jobs.

  • The employment must be for a limited period of time, such as a one-time occurrence, seasonal, or intermittent need.
  • Employers seeking to hire H-2B workers must obtain a certification from the Department of Labor that proves there are not enough U.S. workers who are able, willing, qualified, and available to work.
  • They must prove that the employment of the H-2B workers will not affect the wages and working conditions of similarly employed U.S. workers.
