The Deferred Action for Childhood Arrivals was created in 2012 by then-President Obama and was intended to provide temporary reprieve to undocumented immigrants who were brought to the United States as children and are often described as “Dreamers.” Many of them are now adults who know no other life than in the United States. And both parties agree they are undocumented immigrants through no fault of their own. Republican Senator Thom Tillis of North Carolina and Democratic Senator Kyrsten Sinema of Arizona have drafted a new bipartisan framework to legalize DACA recipients. The new DACA bill is intended to bolster border security. It will also provide a pathway to citizenship for undocumented immigrants brought to the United States as children.
The framework for the DACA bill hopes to include $25 – $40 billion. Border security funding, a pay raise for Border Patrol agents and additional resources for Customs and Border Protection officers would use this money.
The most recent DACA final rule was a setback for Dreamers and went into effect on October 31, 2022. The 5th Circuit Court of Appeals found that the Obama administration did not have the legal authority to create DACA in 2012.
The appeals court did not order the Biden administration to shut down DACA completely or stop processing renewal applications. While the future of DACA remains uncertain, USCIS continues to accept and process DACA renewal and employment authorization renewal requests.
