does a student lose their F-1 status if they are granted TPS | Godoy law office immigration lawyers

FAQ: Does A Student Lose Their F-1 Status If They Are Granted TPS?

An F-1 student does not automatically lose their student status if they are granted Temporary Protected Status (TPS). Both statuses can coexist, allowing you to benefit from the protections of TPS while maintaining your ability to study in the United States. However, it’s important to understand the requirements of each status.

Facts About F-1 Students With TPS

  • F-1: Requires full-time enrollment, maintaining good academic standing, and following specific employment rules (on-campus work, Optional Practical Training).
  • TPS: Allows for temporary residence and work authorization but doesn’t replace your F-1 visa.
  • You can apply for and receive TPS without jeopardizing your F-1 status.
  • You must continue to comply with all F-1 visa regulations to maintain your student status.

The Department of Homeland Security (DHS) has extended the re-registration periods for TPS designations of El Salvador, Haiti, Honduras, Nepal, Nicaragua and Sudan. The re-registration period under the TPS designation of:

  • El Salvador is currently open and runs through March 9, 2025;
  • Haiti is currently open and runs through August 3, 2024;
  • Honduras is currently open and runs  through July 5, 2025;
  • Nepal is currently open and runs through June 24, 2025;
  • Nicaragua is currently open and runs through July 5, 2025; and
  • Sudan is currently open and runs through April 19, 2025.
You should seek professional guidance from an experienced immigration attorney for personalized advice regarding your specific situation.
