President Biden’s Build Back Better reconciliation and infrastructure bill was submitted to Congress on November 5, and key provisions of the bill would make more business immigration visas available including:
• recapturing unused family and employment-based green card visa numbers from 1992 to 2021
• retaining the availability of Diversity Visas from fiscal years 2017 to 2021 for applicants who experienced processing delays
• making it possible for individuals with approved employment-based immigrant visas and priority dates more than two years away to file applications for adjustment of status by paying an additional $1,500 fee
Additional immigration provisions in the Build Back Better bill include:
• 5-year parole for some migrants who have entered the United States since 2011 and would be allowed to stay in the U.S. if they file for parole, pay an administrative fee, as well as a background check
• increases to many USCIS filing fees
• adding $2.8 billion to the USCIS budget to increase its capacity, especially due to the backlog and staffing issues as a result of the pandemic
The Build Back Better bill does not include the comprehensive immigration reform many expected, including a path to citizenship for undocumented immigrants.
Congress passed bipartisan infrastructure legislation. The White House is confident the bill will pass the House by Thanksgiving, and President Joe Biden is expected to sign the bipartisan infrastructure deal into law.
