New Southern Border Asylum Policy Starts in Late May

Starting in late May, the Biden administration’s new southern border asylum policy will let asylum claimants have their claims evaluated by asylum officers, instead of the current reviews by overburdened immigration judges. This new policy is intended to greatly shorten the process. The current process can take the immigration courts years to reach a decision. The new process is intended to deliver a decision within months.

First announced in March to end the pandemic-era rule that turned migrants away at the border, the administration is rolling out the policy in stages. Stage 1 launches in late May, and will likely apply to a “few hundred” immigrants a month, said immigration officials.

“Individuals who qualify for asylum will receive protection more swiftly, and those who are not eligible will be promptly removed rather than remaining in the U.S. for years while their cases are pending,” Alejandro N. Mayorkas, the homeland security secretary, said in a statement on Thursday. “We are delivering justice quickly, while also ensuring due process.”

President Biden campaigned heavily on his pledge to restore the immigration system.

Since March 2020, U.S. southern border officials have used Title 42 policy to limit the spread of COVID-19 to quickly expel undocumented migrants at the U.S.-Mexico border and send them back to Mexico or to their home countries.
