President Biden let Trump era visa restrictions that had barred entry for numerous temporary workers expire on March 31. The U.S. Department of State announced on April 6, 2021, new visa processing procedures to address the visa backlog. Nonimmigrant visa processing restarts based on local embassy and consulate conditions and restrictions. Nonimmigrant visas that will resume processing include:

• multinational managers and executives

• specialty occupation employees

• non-agricultural laborers including landscapers, camp counselors, resort employees

• au pairs

• exchange students

• many others

Applicants should check the website of the nearest embassy or consulate for the current operating status. Former President Trump instituted work visa restrictions in 2020 during the COVID pandemic, saying they would help protect the American labor market.

H-1B, H-2B, J, and L Nonimmigrant Visa Backlog

The State Department is working to reduce the H-1B, H-2B, J, and L nonimmigrant visa backlog while ensuring the safety of our staff and applicants and protecting our national security. The State Department also said that visa applicants in the H-1B, H-2B, J, and L nonimmigrant categories who have not yet been scheduled for an interview will have their applications prioritized and processed in accord with the resumption of routine services at U.S. embassies and consulates around the world. Visa processing changed due to COVID-19 restrictions that vary from country to country. Visa applicants should check the operational status of their closest U.S. Embassy or Consulate.

The State Department also said that applicants who were refused a visa under the temporary restrictions should reapply by submitting a new application and fee.
