H-4 Work Authorization Changes Withdrawn

The Biden administration withdrew the proposed changes to the H-4 EAD work authorization program on January 25, 2021. The Trump administration proposed the elimination of the work visas for spouses of H-1B workers as part of their overall goal to restrict legal immigration. H-1B visas for professional workers in specialty occupations.

What Is An H-4 EAD Visa?

An H-4 visa is a nonimmigrant, temporary visa Employment Authorization Document (EAD) for spouses and minor children of H visa holders, including H-1B high-skilled workers and H-2A and H-2B for agricultural and nonagricultural seasonal workers. In reality, the vast majority of H-4 visa holders are professional, degree women married to H-1B holders.

Immigrants Create Jobs For All Americans

Research from the Kellogg School of Management says immigrants create more jobs than they take. The study found that immigrants are more likely to create a business than native-born Americans:

• 0.83% of immigrants in the workforce created a business between 2005 and 2010 v 0.46% of native-born Americans in the workforce created a business between 2005 and 2010

• immigrants represent about 14% of the U.S. workforce but account for closer to one-quarter of U.S. patents

• firms with an immigrant founder are 35% more likely to have a patent than firms with no immigrant founders

• workers in immigrant-founded firms receive 4.1% higher wages on average
