My name is Mario Godoy and I’m an attorney at Godoy law office. I want to talk to you about the parole in place program. Parole in place is a process by which the US Citizenship and Immigration Services assists the immediate family members of US military personnel to become eligible to adjust status in the United States and thus being able to become permanent residents of the United States. So, this includes the spouses, children, and parents of US military members. Under the current immigration law, no one who came to the United States without inspection can adjust status unless he or she falls into a category or some type of special rule applies. Now, in the instance where an adjustment is not an option the family member must do consular processing. Now, parole in place allows that family member to adjust status inside of the US and thereby avoid lengthy separation that can harm the military members morale, readiness, or the ability to complete his or her service. It’s important to note that parole in place is available only to persons who are currently present in the United States and that the parole in place can be different from state to state. However, in all instances it always starts with putting together a parole in place request letter with supporting documentation. Parole in place requests are purely discretionary and you should not assume that it’s going to be approved until USCIS officially notifies you and because parole in place requests are not automatically granted you should definitely discuss the benefits and the risks of making such a request with a qualified immigration attorney.
