Green Cards RFE Response Extended to 60 Days

U.S. Citizenship and Immigration Services (USCIS) is extending the temporary policies first announced in March to assist applicants, petitioners, and requestors who are responding to certain to allow Green Card applicants to respond to Requests for Evidence (RFE) within 60 days of receiving one. The extension is due to the COVID crisis, and applies to requests dated between March 1 and September 11, 2020. USCIS offices were closed for in-person services for several months. Green Card applicants now have a 60-day grace period to respond to the RFE request.

What Is A Green Card RFE?

A Request for Evidence (RFE) is a letter or notice from a USCIS officer to request additional information for pending applications. Often an RFE is received months after submitting your Green Card application. A request for more evidence is not a denial notice, it is only a statement that USCIS needs more information before they can rule on your application.

1st Steps Following an RFE Request

The first step in responding to an RFE is to read the entire RFE carefully. You will typically only get an RFE once, which means you have only one chance to respond to any and all remaining questions that USCIS has about your application. Your Request for Evidence will give you a due date to submit your response package to the government.

You should photocopy your entire RFE response package, including the original RFE notice. When you mail it back to USCIS, make sure you have a way to track the package and confirm that it was delivered. Keep this proof of delivery with your photocopied RFE package.
