TPS – Temporary Protected Status – is humanitarian relief to protect people who arrive in the U.S. after their country is declared protected due to dangerous conditions, as well as to people from that country who are already in the United States when their home country is designated as TPS by the Department of Homeland Security (DHS). On November 1, 2019, DHS published a Federal Register notice extending the validity of TPS-related documentation for beneficiaries under the TPS designation for El Salvador, Haiti, Honduras, Nepal, Nicaragua and Sudan through January 4, 2021.
A federal appeals court panel ruled on September 14 that the Trump administration can end humanitarian protections for over 300,000 immigrants from Sudan, Nicaragua, Haiti and El Salvador. The Trump administration has been trying to limit TPS protections. The court ruled that the Department of Homeland Security secretary “possesses full and unreviewable discretion” in providing or denying TPS status. Over 300,000 immigrants could be deported next year if the Temporary Protected Status ruling holds against appeals.
In Maryland, a federal judge has ruled that acting DHS Secretary Chad Wolf is unlawfully serving in his role because his appointment was invalid under the DHS succession policy. That ruling may temporarily block some asylum restrictions including the September 14 TPS ruling.
TPS holders and their children who are U.S .citizens challenged the expected move to end the protections, saying that the decision was motivated by racism. The National TPS Alliance is protesting President Trump’s ‘racist’ attempts to end immigrant protections and has begun a “Road to Justice” bus tour that is going to 54 cities in 32 states through November 13. The tour will end in Washington, D.C., where the TPS group plans to appeal to legislators in Congress.
