Watch: Immigration Attorney Mario Godoy Discusses if Filing for Unemployment Affects Your Green Card Application

Transcript

Today I am going to answer the question, Will filing for unemployment hurt my green card?
Many green card holders are concerned about applying for unemployment insurance because they do not want to be considered a public charge. At the heart of this concern is that the current President is pushing hard to deny green cards to those using public welfare.
Unemployment insurance is not welfare. It is considered an earned benefit and does not affect your immigration status. Remember: this is insurance that you and your employer have already paid for. The only thing that you need to ensure is that you identify yourself a non-US citizen on your application.
USCIS has also announced publicly that unemployment insurance is an earned benefit that isn’t considered for the public charge review.
It’s important for you to know that once you are a green card holder the public charge rules are not considered when applying to renew your green card. And applying for unemployment insurance is not considered in your citizenship application.
If you have any questions, please call us today we can schedule you for a consultation.
