Supreme Court Decision on DACA: Ruled in Favor of Dreamers

On June 18, 2020, the United States Supreme Court ruled in favor of Dreamers, ruling that the Trump administration cannot end DACA, the Deferred Action for Childhood Arrivals. The DACA program was initiated in 2012 by the Obama administration to protect young people brought to the United States as children to shield them from deportation and let them attend school and get work permits. The decision will protect about almost 800,000 Dreamers from deportation.

Chief Justice John Roberts led the majority and said the government did not comply with procedural requirements and failed to give an “adequate justification” to end the federal program. Terminating Obama’s executive order to end DACA was one of President Trump’s 2016 key immigration campaign promises. The Trump administration moved to end the DACA program in September of 2017. Legal experts had anticipated that the conservative court would rule in favor of the government’s case.

Immigration lawyers argued to the Court that over 27,000 DACA recipients are frontline health care workers responding to the coronavirus epidemic “including dentists, pharmacists, physician assistants, home health aides, technicians” and nearly 200 medical students.

Chicago immigration lawyer Mario Godoy said,

“Today the Supreme Court ruled in favor of Dreamers. This is a big legal win for DACA, and for our country’s immigration policies. This was a political gambit that violated the due process rights of DACA recipients. This is an important decision in favor of these young adults and their families.”

Despite Trump’s campaign promises, DACA is a politically popular program to protect the rights of innocent children and their fight to become United States citizens.
