The fate of nearly 700,000 Dreamers – young undocumented immigrants brought to the United States as children who received protection under the Deferred Action for Childhood Arrivals program (DACA) – will be decided by the United States Supreme Court based on arguments heard by the Court on November 12. President Barack Obama created the DACA program in 2012 to create a path to citizenship for these children who unknowingly became undocumented citizens. DACA provides a temporary status that shields Dreamers from deportation and allows them to work for two years and is renewable, but it does not provide a path to citizenship. The Trump administration moved to end the program on the grounds that it is illegal, resulting in a series of Federal Court rulings that favored DACA and working its way to Tuesday when the Supreme Court heard the DACA case.
The New York Times reports that the Supreme Court’s conservative majority appeared to side with the Trump administration during the arguments:
The court’s liberal justices probed the administration’s justifications for ending the program, expressing skepticism about its rationales for doing so. But other justices, including President Trump’s two appointees, indicated that they would not second-guess the administration’s reasoning and, in any event, considered its explanations sufficient.
A Supreme Court ruling on the DACA program is expected next spring during the 2020 presidential election. A potential path to citizenship for Dreamers passed the House in June but has not passed the Senate. If the court sides with the Trump administration and rules that the program is illegal, most DACA recipients will keep the current two-year protection that is in place until President Donald Trump or his Democratic successor takes the oath of office in January 2021.
