New USCIS Rules for Family-Based Immigration – What You Need to Know (August 2025)

If you are applying to bring your family to the United States, there are new policy guidance rules. On August 1, 2025, U.S. Citizenship and Immigration Services (USCIS) changed how it looks at and evaluates family-based immigration cases. Note: These are not new immigration rules; USCIS is being more strict about enforcing family-based immigration rules that are already in place.. 

The enforcement and strict adherence to these family immigration rules may make it harder to get approved and can increase the chance of being denied.

 

What to Be Aware of With Family-Based Immigration

  1. More Interviews 
    • USCIS can now require more in-person interviews to prove your relationship is real. 
    • This includes marriage-based petitions and other family visas. 
  2. Faster Denials 
  3. Risk of Deportation 
    • If your case is denied and you are in the U.S. without legal status, USCIS can send you a Notice to Appear in immigration court. 
  4. Stricter Fraud Checks 
    • USCIS will spend more time checking if a marriage or family relationship is genuine. 
  5. New Rules for Children’s Ages 
    • Starting August 15, 2025, children’s age for the Child Status Protection Act (CSPA) will be counted using a stricter method. 
    • Some children may “age out” (turn 21) and lose eligibility if the case takes too long.
