Acting Secretary of Homeland Security Chad Wolf resigned on January 11, 2021, just days after the Capitol Hill riots, effective immediately. In submitting his resignation to President Trump, Wolf listed the many “court rulings regarding the validity of my authority as Acting Secretary.” Immigration lawyers and advocates have challenged the legality of Wolf’s appointment in November 2019 as acting secretary of DHS, which never went to the Senate for a confirmation vote.
The Department of Homeland Security is the third largest Department of the U.S. government, with a workforce of 229,000 employees. Key government agencies overseen by DHS include U.S. Citizenship and Immigration Services (USCIS), TSA, Customs and Border Protection and Immigration and Customs Enforcement
Many DHS rulings and policies, significantly the changes to the Deferred Action for Childhood Arrivals (DACA) program and H-1B visa program changes, faced legal challenges in court including the validity of Wolf’s appointment to his role.

Federal Emergency Management Agency Administrator Pete Gaynor is the new acting secretary of Homeland Security until January 20, when President Biden is inaugurated and appoints his own Cabinet. Wolf will remain with DHS as an under secretary for policy, a position for which he was confirmed by the Senate.
