Illinois state lawmakers are considering a bill that would allow noncitizens to vote in school board races. But only if they have children enrolled in that respective school district. The bill would also require that a warning is provided to noncitizens about the possibility of federal officials accessing their immigration status through voter registration records.
State Sen. Celina Villanueva, Democrat Chicago filed the Senate Bill 1565 on February 6. The bill to allow noncitizens to vote in school board races states:
“elections conducted under the provisions are considered non-State elections and are not subject to the citizenship requirement in the Illinois Constitution.”
The bill would require the Illinois State Board of Education to provide an affidavit for noncitizens. The noncitizens would fill out the affidavit before voting in a school board race to ensure they understand the potential consequences.
Federal law prohibits noncitizens from voting for federal offices, such as the president and Congress. Noncitizens who vote in federal elections can be put in removal proceedings.
