U.S. Citizenship and Immigration Services (USCIS) announced that certain parolees can now file Form I-765, Application for Employment Authorization, online effective immediately. Individuals with temporary legal authorization to reside in the U.S. for humanitarian reasons can seek employment authorization under the Public Interest parolee category (c)(11). The new online I-765 application online filing applies to most parolee applicants. Some people who want a filing fee waiver or are eligible for a fee exemption, such as Afghan nationals paroled through Operation Allies Welcome, must continue to submit parolee I-765 applications by mail.
USCIS is facing a significant backlog in processing immigration applications. Introducing efficiencies such as online filing is part of their effort to clear the backlog and modernize U.S. immigration processes. Currently, the immigration process is mainly a manual, pen and paper system, with antiquated technology and limited electronic resources.
Non-citizens must have an Employment Authorization Document (EAD) work permit to work in the United States while their permanent resident application is pending or if they have a non-immigrant status visa such as an F-1 or M-1 student visa. Form I-765 is the application form to apply for an EAD. EAD work permits are typically for one year and are renewable. U.S. law requires all U.S. employers to prove that employees, regardless of citizenship or national origin, are legally authorized to work in the United States. Green card holders are lawful permanent residents and do not need an EAD.
Filing for an EAD can be stressful, expensive and takes time. Even a make a minor mistake on parolee I-765 applications can result in the officials denying your application.
