On June 30, the United States Supreme Court ruled that the Biden administration has the authority to end MPP (the Migrant Protection Protocols), commonly called the “Remain in Mexico” policy, that forces asylum-seekers to wait in Mexico during their immigration proceedings. MPP immigration policy was enacted by former President Trump. Although President Biden ended the program on his first day in office, Remain in Mexico was reinstated under court order and under a new agreement with the Mexican government; and went back into effect on December 6.
In the 5-4 decisions to end MPP, Chief Justice John Roberts wrote for the majority. He said the relevant immigration statute “plainly confers a discretionary authority to return aliens to Mexico during the pendency of their immigration proceedings.”
“As Secretary Mayorkas concluded in October 2021 after a thorough review, the prior Administration’s Migrant Protection Protocols (MPP) has endemic flaws, imposes unjustifiable human costs, and pulls resources and personnel away from other priority efforts to secure our border. We welcome the Supreme Court’s decision affirming that the Secretary has the discretionary authority to terminate the program, and we will continue our efforts to terminate the program as soon as legally permissible.”
