USCIS Changes to Fees, Forms and Premium Processing

U.S. Citizenship and Immigration Services (USCIS) has finalized a new rule impacting several key areas for immigration and naturalization applicants and petitioners. The new fees, forms and premium processing are effective April 1, 2024. In their new rule published January 30, 2024, USCIS made the first fee increase for most immigration services since 2016. The proposed USCIS fee increases were announced in 2023 and were under review and public comment. Here is a summary of the key changes:

USCIS Fee Increases

USCIS increased the fees for many purposes, including increasing staff, meeting contract costs, improving adjudicator training and providing asylum and refugee support. 

  • Higher fees for many employment-based petitions and green cards.
  • A new “Asylum Program fee” will be introduced for certain applications.
  • Nonprofits and “small employers” may be exempt from fee increases or receive reduced fees.
  • Online filing, where available, will offer a $50 discount on filing fees.

USCIS Form Changes

  • New versions of certain application forms.
  • Some forms have no grace period and you must use the new version immediately after the changes go into effect April 1.

USCIS Premium Processing Changes

  • The processing timeframe for premium processing service will shift from calendar days to business days. This means it could take slightly longer to receive a decision through expedited premium processing.

New or increased USCIS fees effective April 1, 2024 include: 

  • I-129 H-1B: $460 to $780  
  • I-129 L-1: $460 to $1,385  
  • I-129 O-1: $460 to $1,055  
  • I-129 E and TN: $460 to $1,015 
  • I-539 dependent extension or change of status (e.g. H-4, L-2): $370 to $470  
  • I-140 Immigrant Petition: $700 to $715  
  • Asylum Program fee: $600 
  • I-485 Adjustment of Status: $1,225 to $1,440 
  • I-131 Advanced Parole (based on I-485): $0 to $630 
  • I-765 Employment Authorization (based on I-485): $0 to $520 
  • H-1B registration: $10 to $215
