Can I File For An Inadmissibility Waiver?

Certain immigration violations make people ineligible for admission to the United States. In some cases, a person whose immigration application is denied can qualify for a pardon, called an inadmissibility waiver. The Immigration and Nationality Act explains the violations that make a foreign national ineligible for admission and legal status in the United States, including: 

• a history of criminal activity

• national security concerns

• missing documentation

• committing fraud on an immigration application

• prior removals

• alien smuggling

• unlaw entry into the United States

• overstaying your legal visa 

If you are inside of the U.S. unlawfully because you entered without permission or overstayed your visa, and your visa application or your Adjustment of Status has been denied, you may apply to USCIS to forgive your violation. 

If you are found inadmissible by an officer during consular processing you will use Form I-601, Application for Waiver of Grounds of Inadmissibility. You may also file Form I-601 if found inadmissible at the end of an adjustment of status interview inside the United States.
