Effective immediately, U.S. Citizenship and Immigration Services (USCIS) has updated its gender policy and will no longer require documentation to prove one’s gender. Applicants can self-identify their gender on immigration applications and forms. This means that the gender marker an individual identifies as will be accepted, regardless of whether it matches the gender marker on their supporting documents.
Additionally, people who wish to change their gender marker are not required to submit proof of their gender identity, except when filing Form N-565, Application for Replacement Naturalization/Citizenship Document.
Only two genders are currently available on immigration forms :
USCIS is adding another ” X ” marker for “another or unspecified gender identity. They announced the new gender policy allowing immigrants to select gender identity other than birth sex on ‘Trans Day of Visibility,’ March 31, 2023. USCIS is in the process of updating its forms and the Policy Manual.
A gender option is now available on passports for American citizens for Americans who identify as neither exclusively male nor female.
